Terms and Conditions

  • All estimates/quotes are based on our understanding of your requirements and the given timeframe. Any changes to the functionality, including micro-improvements, may incur additional costs accordingly. Please ensure and clarify our understanding during a face-to-face meeting.
  • By accepting a quote, you agree to and accept the terms and conditions of Smart App Designers. Acceptance can be verbal, by email, payment of initiation, or signing a quote.
  • Clients must ensure that we have included all requirements in the quotes/proposals/estimates and that we fully understand their requirements. Clear guidelines and specific details must be provided. If such details are not provided, we will proceed based on our understanding of the requirements and quote accordingly. Any discrepancies arising later may lead to additional costs to accommodate the changes.
  • Any complexity related to specific tasks must be advised in advance and included in the proposal for costing purposes. We operate in good faith and rely on clients to disclose the full picture at the time of quotation. Any discrepancies due to unclear requirements will not be borne by Smart App Designers.
  • There are limited man-hours allocated to each task, including project management and digital strategy. Minor changes may be included within the allocated hours and will be analyzed case by case.
  • Smart App Designers will make every effort to complete the project/changes within the given timeframe. Reasonable delays are accepted if functionalities are redefined or modified.
  • Delays on the client’s end may delay the project, proposed timeframes, and may incur additional costs.
  • Bugs (programming errors) reported during or shortly after development will not attract additional charges.
  • Re-work on already completed tasks or changes in design after approval will incur additional charges. Modifications requested during or after development completion will also incur additional charges.
  • Website/application content and related materials must be provided within the first two weeks of starting the project. Delays may extend project timelines and incur additional charges.
  • Our websites/applications are tested on PCs and include recent versions of IE, Firefox, Chrome, and Safari. Additional testing on other browsers must be requested in advance.
  • Responsive/multi-device compatible web pages are tested on iPhones and iPads. Testing on other devices should be discussed in advance.
  • If your website/application is not hosted on Smart App Designers’ servers, additional hours required for server or network-related issues are not included in our quotes and may be charged separately.
  • Stalling a project for over two calendar months will incur $99/week administration costs and may increase previously approved estimates. To avoid charges, notify us in writing in advance and ensure the account is up to date based on completed work.
  • Smart App Designers’ software codes (excluding open-source software) are proprietary. Codes can be handed over at an additional cost once all invoices are settled. The codes may only be used for development or modifications for the specified client and cannot be resold or duplicated.
  • Proprietary CMS (if applicable) and software built by Smart App Designers cannot be transferred to external hosts. Licenses are granted for use only while hosting is paid.
  • The website/software application is designed for deployment via commercial-grade web servers. Performance may vary if deployed on generic office network environments.
  • Depending on the functionalities required, 3rd party components like payment gateways or SSL certificates may be needed. While we assess their suitability, unforeseen limitations of 3rd party components are beyond our control.
  • Smart App Designers takes no responsibility for maintaining open-source products such as WordPress or Joomla. Regular updates and backups are the client’s responsibility.
  • The client must acknowledge that unforeseen circumstances may delay development, especially when integrating third-party software. We aim to meet timelines but expect understanding for reasonable delays.
  • Domain registration/renewal charges are not included unless specified. Hosting charges are also excluded unless mentioned. Hosting must meet the requirements of the technology used. Full hosting access is required for testing and deployment.
  • Smart App Designers generally builds and tests websites/applications on its servers or hosted domains. Test servers are not accessible to clients or third parties. Full payment of invoices and dues is required before transferring to a third-party server.
  • Upon full payment, Smart App Designers grants an unconditional license to the customer for the use of graphics, texts, and images on the published website. This excludes the intellectual property of the website’s production, including programming codes, database structures, and scripts.
  • All communications are conducted via email. Clients are responsible for updating us with their current email addresses.
